A Queensland court has granted Australian men who were convicted of distributing unlicensed prescription medicines over a four-year period, including the illegal sale of Viagra.
The Commonwealth Court of Australia, which was established under the Australian Consumercribed Drug Act, has now fined the Commonwealth $1 million, with a further 2,000 cases being added to the court's record. The Commonwealth Court was informed by the Department of Health that the drug's licence expired by July 1, 2019, and was not used for any purpose beyond that date.
In 2012, the Court heard that Viagra was being sold under a label that contained the incorrect words: 'erectile dysfunction drugs'. That label contained the incorrect dosage of the erectile dysfunction drug sildenafil, which was sold without a prescription. Under the Australian Consumercribed Drug Act, the medicine was sold over the counter, without a prescription, without a prescription from a doctor, and without a prescription from a pharmacy. It is now known as the Viagra/Sildenafil product.
The Commonwealth Court heard that men who had not previously been diagnosed with erectile dysfunction, who were not advised of the problem and who used Viagra or its generic equivalent, had been given a "black box" warning from the Food and Drug Administration.
